2. EXCLUSION OF ASSEMBLY LIABILITY: By opening this packaging and commencing assembly, the purchaser acknowledges that the supplier accepts zero liability for any injury, loss, or property damage resulting from incorrect assembly, poor workmanship, or deviation from these instructions.
3. STATUTORY GUARANTEES: Nothing in this disclaimer excludes, restricts, or modifies any consumer guarantees or rights under the Australian Consumer Law (ACL) that cannot be lawfully excluded. However, to the maximum extent permitted by law, the supplier’s liability for a breach of a non-excludable condition is limited to the replacement of the product components or the cost of obtaining equivalent components.

△ WARNING: CRITICAL GROUND STABILITY & FOUNDATION REQUIREMENTS
- NO CONCRETE SLAB REQUIRED: This structure includes an integrated, fully engineered raised flooring system and does not require a poured concrete slab.
- MANDATORY SURFACE PREPARATION: The structure must NOT be placed directly on raw earth, grass, or uncompacted ground. It must be installed on a level, highly compacted, and well-draining base (e.g., compacted road base, crusher dust, or pre-leveled concrete pavers/piles at load-bearing points).
- WEIGHT STABILITY HAZARD: Due to the heavy-duty 1,100kg unladen weight of this structure, any ground sinking or uneven settling will cause structural shifting. This can lead to panel warping, frame twisting, and door/window misalignment.
- WIND SECUREMENT & ANCHORING: While the 1,100kg weight offers substantial ballast against wind uplift, this structure must still be mechanically anchored to the ground. The purchaser must utilise heavy-duty earth augers, ground screw anchors, or deep-set pegs capable of resisting local wind forces.
- EXCLUSION OF LIABILITY: The supplier accepts zero liability for structural failure, operational issues, or property damage resulting from poor ground preparation, soil erosion, shifting foundations, or a failure to install appropriate ground anchors.

Recommended Tie-Down & Anchoring Options
- ENGINEERING COMPLIANCE: While the 1,100kg unladen weight of this garden shed provides substantial built-in ballast, it is highly recommended to install mechanical ground anchors. This ensures safety in high-wind events and maintains structural alignment.
- APPROVED SPECIFICATION SYSTEM: For sites utilising a compacted road base, crusher dust, or soil foundation instead of a concrete slab, the supplier recommends using a certified percussion earth anchor system, such as the AncorLoc Duckbill anchor range (or an equivalent system engineered for portable and Class 10a buildings).
- SITE AND WIND CODE ADAPTABILITY: Wind forces and soil types vary drastically across Australia. The purchaser should consult an anchor specialist or structural engineer to determine the exact anchor model, depth, and pull-out rating required for their local wind classification (e.g., N1, N2, N3) and soil density.
- INSTALLATION METHOD: Tie-down anchor cables or tensioning straps must be structurally fixed to the main load-bearing perimeter beams of the shed’s steel chassis. Do not attach anchors to non-structural wall paneling or flashings.
- LIMITATION OF LIABILITY: The supplier does not manufacture, test, or supply anchoring hardware. The purchaser assumes total liability for sourcing, engineering, and installing a tie-down system adequate for their specific site conditions. The supplier accepts zero liability for wind-uplift damage or ground sliding resulting from a failure to anchor the building correctly.
NSW Exempt Development Compliance
Local Government & Regulatory Compliance
- BUYER RESPONSIBILITY: While this kit may meet the size and height thresholds for “Exempt Development” under the State Environmental Planning Policy (SEPP) in New South Wales, the purchaser holds sole responsibility for verifying local council setbacks, boundary clear-zones, bushfire (BAL) zones, and overland flow path restrictions.
- NATIONAL CONSTRUCTION CODE (NCC): “Exempt from Council approval” does not mean exempt from structural compliance. The installation must still comply with relevant performance requirements of the National Construction Code (NCC). The supplier is not responsible for any council fines, demolition orders, or remediation costs arising from non-compliant placement.
Prohibition of Unauthorised Modifications
- INTENDED USE ONLY: This product is engineered and sold strictly as a non-habitable Class 10a building (Garden Shed). It is not designed, insulated, or certified as a habitable dwelling (Class 1a).
- NO STRUCTURAL ALTERATIONS: Any cutting, welding, or structural alteration of the steel frames or paneling to add unauthorised doors, windows, internal walls, or utility penetrations (plumbing/electrical) voids all warranties.
- EXCLUSION OF LIABILITY FOR CONVERSIONS: The supplier accepts zero liability for any injury, health issues, or compliance breaches resulting from the unapproved conversion of this shed into a habitable space, home office, or accommodation unit.
